LABOR JUSTICE IN THE CONTEXT OF FREEDOM OF ASSOCIATION: AN ANALYSIS OF THE ROLE OF LABOR UNIONS FROM THE PERSPECTIVE OF LABOR JUSTICE THEORY

Ribka Sri Rezeki Simanjuntak, Tri Sulistiyono

Abstract

This study examines labor justice in freedom of association, focusing on analyzing the role of labor unions using the perspective of Labor Justice Theory. This study departs from the reality that labor unions in Indonesia often face structural challenges, both in protecting workers' rights and in realizing the principle of justice in the workplace. Using a normative juridical approach, this article analyzes national legal provisions, particularly Law No. 21 of 2000 concerning Trade Unions/Labor Unions and Law No. 13 of 2003 concerning Employment (along with its amendments in the Job Creation Law and Law No. 6 of 2023), as well as the principles of labor justice according to Labor Justice Theory. The results of the analysis show that labor unions have a strategic role in fighting for the normative rights of workers, negotiating collective labor agreements, and monitoring the implementation of labor laws and regulations. However, the implementation of freedom of association in Indonesia still faces obstacles in the form of union busting, restrictions on the right to organize, and power imbalances between workers and employers. This article recommends strengthening legal protection for labor unions, increasing advocacy capacity, and more rigorous law enforcement so that the principles of labor justice can be realized in practice.
